Private archives can be legal entities or organizational units within a legal entity.
Archives can be established by citizens of the Republic of Croatia, EU/EEA and third countries.
The following conditions must be met for establishment and proofs secured:

Act on Archival Records and Archives (OG 61/18, 98/19, 114/22 and 36/24)
Regulations on the conditions for the accommodation, equipment, protection and processing of archival records, and the number and structure of professional archive staff (OG 121/19)
Authorization
The decision on the existence of the conditions for the establishment of an archive is issued by the Ministry of Culture and Media, based on the prior consent of the minister responsible for culture.
Deadline for obtaining: 30 days from the date of submission of a proper request.
Legal remedies
An administrative dispute may be initiated against the decision by filing a lawsuit before the competent administrative court within 30 days from the date of receipt of the decision.

- necessary and appropriate working and storage space and appropriate equipment
- work of professional archival staff
- funds for the establishment and start of the archive, as well as funds for its operation
- work and development plan.
