FREEDOM OF ESTABLISHMENT
 
If you already have a registered establishment in another EU/EEA country, as a natural and legal person, you are enabled to provide services on a permanent basis, with the registration of an establishment in Croatia.
 
An application for a single safety certificate (SSC) can be submitted by any railway undertaking whose business is the transport of freight and/or passengers, whether or not limited to the operation of rail transport only, confirming access to the railway infrastructure.
 
All applications for the issuance of a single safety certificate (regardless of which the competent authority is) must be submitted through the electronic One-Stop Shop (OSS) system. This includes any new requirements, renewed or extended requirements for the issuance of a single safety certificate (SSC).
 
The applicant should comply with Commission Implementing Regulation (EU) 2018/763 laying down the practical arrangements for issuing single safety certificates and the related ERA Guide, which together provide information on the legal basis, the notification procedure and information on what is required of the applicant. The application should contain the complete safety management system documentation in Annex I to the said Regulation.

The application shall be submitted to the authority responsible for issuing the safety certificate. The process is similar regardless of which the competent authority is - ERA or the Agency - it is a single European authorization system (SSC). In case a railway undertaking operates in more than one Member State, the competent authority for issuing the single safety certificate is ERA (European Union Agency for Railways). The applicant may choose the competent authority: ERA or the Agency if the operation of the carrier is limited to the area of the railway network within the Republic of Croatia.

Remedies
 
No appeal is allowed against the decision, but an administrative dispute may be initiated before the competent administrative court within 30 days from the date of delivery of the decision.
