A temporary employment agency is an employer that assigns a worker (posted worker) to another employer (user) under a temporary work assignment agreement to perform tasks on a temporary basis. In addition to the aforementioned activities, the temporary employment agency may also carry out employment-related activities (recruitment assistance, vocational guidance and education to increase the employability of the workforce), market research and public opinion polling activities and management consultancy activities. The Agency may assign workers to beneficiaries provided that they are registered in accordance with a special regulation and entered in the Register of temporary employment agencies kept by the Ministry of Labour, Pension System, Family and Social Policy.
FREEDOM OF ESTABLISHMENT
As natural and legal persons, if you have a registered establishment in another EU/EEA country, you are allowed to provide services in Croatia on a permanent basis, with registration of your establishment in Croatia and with the photographed or scanned submission of the following documents, i.e.:
- Proof of registration for the said activity (in the EU/EEA) as a copy of an extract from the relevant register, based on which entry in the register of the ministry responsible for labour is made, which is a condition for starting work; in doing so, the agency must not be registered for any other activities
- application for entry in the register signed by an authorized representative
The Agency shall provide the Ministry with statistics on temporary agency workers in the manner laid down in the
rules, no later than 31 January of the current year for the previous year. The data shall be transmitted exclusively in electronic form via a dedicated application -
Temporary employment.
Agencies are required to indicate in legal transactions, in business documents, on each letter and contract, the number under which they are entered in the ministry’s records.

Authorization
The Ministry shall issue a certificate of registration containing the number under which the agency is registered and the date of registration.
Time limit for issuing the certificate: 10 days.
Legal remedies
Within any time limit, an objection may be lodged at
pisarnica@mrosp.hr with the head of the competent Ministry. The head of the body shall decide on the objection by way of a decision within 8 days of the date on which the objection was lodged. Administrative proceedings may be brought before the Administrative Court of the Republic of Croatia against a negative decision of the head of authority within 30 days of notification of the contested decision.
