Physical planning

First option: FREEDOM TO PROVIDE CROSS-BORDER SERVICES
 
If you are already established in another EU/EEA state, as a natural and legal person you have the freedom to provide services on a temporary and occasional basis, without the obligation of establishment in Croatia and without a prior check.
 
The legal entity that carries out the activity of physical planning shall submit the statement form to prostorno.uredjenje.suglasnosti@mpgi.hr with a copy and translation of the following documents:
  • evidence/an attestation of the right to pursue the activities in the state of establishment or a valid licence/document regulating this right to pursue the activities in another EU / EEA state
  • data on liability insurance valid in the territory of the Republic of Croatia or the EU
 
To perform the tasks of spatial planning, a natural person of the architectural profession established in another EU/EEA state shall submit a statement directly to clanstvo@arhitekti-hka.hr or via the e-Citizens system
 
The statement shall be accompanied by a copy and translation of the following documents:
  • Proof of citizenship - a copy of a valid passport, a copy of an identity card and/or a certificate of citizenship
  • Proof of establishment for business purposes in an EEA Member State, i.e. a certificate confirming that, in an EEA contracting state, the applicant performs spatial planning activities in the capacity of a responsible person of the architectural profession
  • Proof of professional qualifications required for the performance of the relevant professional activities of the architectural profession
  • Proof confirming that the right to perform professional activities has not been temporarily or permanently revoked
  • Proof that, in another EEA contracting state, the applicant is insured against professional liability for damage, appropriate to the type and level of risk, and that such insurance or guarantee is equivalent or substantially comparable in terms of purpose or coverage provided
  • Proof of additional insurance, where the existing insurance is not equivalent, to cover aspects not covered by the existing insurance (insured risk, insured upper limit of liability, possible exclusions from coverage)
  • Proof of payment of the administrative fee in the amount prescribed by the Decision on Administrative Fees of the Chamber
 
If an EU certificate is submitted, the following shall not be submitted:
  • evidence of establishment in another EU/EEA state (if applicable)
  • attestation that the right to pursue professional activities has not been revoked (if applicable)
  • evidence of formal qualifications/professional qualifications
 
 
Second option: FREEDOM OF ESTABLISHMENT
 
If you are established in another EU/EEA state, as a natural or legal person you have the freedom to provide services on a permanent basis in the Republic of Croatia, with the registration of establishment
 
Activities of physical planning can be performed by a certified architect-urban planner in:
• a sole-practice office
• a joint-practice office
• a legal person
 
The request for the establishment of a sole-practice office or for the establishment of a joint-practice office shall be submitted directly to clanstvo@arhitekti-hka.hr or via the e-Citizens system.
 
The request for the establishment of sole-practice office shall be accompanied by:
  • proof of paid fee
 
The request for the establishment of a joint practice office shall be accompanied by a photograph or scan of:
  • agreement on the establishment of a joint practice office
  • proof of paid fee
 
In a joint-practice office a certified architect -urban planner may perform all professional physical planning tasks.
 
In a sole-practice office a certified architect -urban planner may as sole practitioner perform:
 
  • tasks related to the preparation of urban development plans
or
  • perform all professional physical planning tasks if he/she submits a request directly to prostorno.uredjenje.suglasnosti@mpgi.hr and evidence that he/she can ensure the participation of one further certified architect -urban planner or evidence that he/she can ensure the participation of at least three experts from different professions
 
A legal person registered for performing professional physical planning tasks may start performing tasks of physical planning if it:
 
  • submits a request for authorisation to perform drafting of urban development plans directly to prostorno.uredjenje.suglasnosti@mpgi.hr and evidence that in performing these tasks it can ensure the participation of a certified architect- urban planner
or
  • submits a request for authorisation to perform all professional physical planning tasks directly to prostorno.uredjenje.suglasnosti@mpgi.hr and evidence that in performing the tasks it can ensure the participation of one further certified architect - urban planner, or evidence that in performing these tasks, in addition to the certified architect-urban planner, it can ensure the participation of at least three experts from different professions
 
Urban planners who hold a foreign professional qualification shall be entered in the Register of Foreign Authorized Persons and shall submit a request to clanstvo@arhitekti-hka.hr or via the e-Citizens system, with the following documentation:
 
  • Decision of the Croatian Chamber of Architects on the recognition of a foreign professional qualification
  • Proof of proficiency in the Croatian language issued by an authorized foreign language school, in accordance with Article 72, paragraphs 3 and 4 of the Act on Spatial Planning and Construction Activities, unless the language of undergraduate education was Croatian
  • Photograph in digital format (ID photo size, 300 dpi resolution, 500 × 400 px)
  • Proof of payment of the registration fee, in accordance with the Decision on the Amount of the Registration Fee and Membership Fee of the Croatian Chamber of Architects
 
 
If the person obtained their educational qualification in the Republic of Croatia, they shall submit:
  • A copy of a valid identity card and/or passport
  • Proof of the obtained educational qualification (a copy of the diploma proving that the applicant completed the appropriate undergraduate and graduate university study programme or an integrated undergraduate and graduate university study programme in the field of architecture and obtained the academic title Master of Engineering, or that the applicant completed the appropriate specialist graduate professional study programme in the field of architecture and obtained the professional title Professional Specialist Engineer, provided that during the entire course of study the applicant obtained at least 300 ECTS credits, or that the applicant otherwise obtained the appropriate level of education in the field of architecture in another manner as prescribed by a special regulation)*
  • Proof of work experience (electronic record of data entered in the central register of the Croatian Pension Insurance Institute)
  • A list of professional activities, evidenced by: an employer’s certificate for whom the applicant performed the activities, or a list of activities certified by a licensed architect-urban planner under whose supervision the applicant performed spatial planning activities. The list of professional activities or the employer’s certificate shall include a chronological list and description of activities performed by the applicant up to the date of submission of the application. For each activity listed chronologically, appropriate proof of the completed work shall be enclosed under the corresponding serial number (for example, a copy of the decision appointing the applicant as a project associate, copies of project cover pages signed and certified by the responsible project designer showing the project associates, etc.)
  • A copy of the Certificate of Passing the Professional Examination for the performance of spatial planning activities
  • Photograph in digital format (ID photo size, 300 dpi resolution, 500 × 400 px)
  • Proof of payment of the registration fee, in accordance with the Decision on the Amount of the Registration Fee and Membership Fee of the Croatian Chamber of Architects
 
 
Recognition of qualification for performing tasks of physical planning
 
The request for recognition of a foreign professional qualification for performing tasks of physical planning shall be submitted by persons of the architectural profession directly to clanstvo@arhitekti-hka.hr or via the e-Citizens system.
 
The request shall be accompanied by the following documentation, in copy and translated, according to the general system:
 
  • Proof of citizenship (a copy of a passport or identity card and a certificate of citizenship issued in the country of origin)
  • Certificate issued by an EEA Member State that recognized the professional qualification of a foreign authorized person who is a third-country national
  • Proof of formal training or other evidence of completed formal education
  • Proof of professional qualification
  • Educational programme with learning outcomes
  • Proof of professional experience
  • Proof of payment of the costs of the procedure in the amount determined by the Decision on Administrative Fees of the Croatian Chamber of Architects (HKA)

Legal remedies
 
You may submit a complaint within 15 days from the date of delivery of the decision.
 
The complaint shall be submitted to the Croatian Chamber of Architects, Ulica grada Vukovara 271, 10000 Zagreb or at clanstvo@arhitekti-hka.hr for the architectural profession
 
The Croatian Chamber of Architects will reject the complaint (if it is untimely), will replace the contested decision with a new one (if the complaint is partially or fully founded) or will submit the complaint to the Ministry of Physical Planning, Construction and State Assets.
 
The Ministry may reject the complaint, annul the decision in part or in full, or amend it.
 
The decision of the Ministry shall be delivered to the party through the Chamber no later than 60 days from the submission of a proper complaint.
 
No appeal may be lodged against the decision of the Ministry, but an administrative dispute may be initiated with the competent Administrative Court of the Republic of Croatia within 30 days of receipt of the decision.
