Tourist services in nautical tourism port

The first option - FREEDOM TO PROVIDE CROSS-BORDER SERVICES
 
If you are established in another EU/EEA state, you are allowed the freedom to provide services on an occasional and temporary basis, without the obligation of establishment in Croatia.
 
An online declaration is sent at pisarnica@mints.hr, along with a photo or a scan of the following documents (signed, without a stamp). The service is provided under the conditions prescribed for business establishment (Second option).
 
The second option - FREEDOM TO ESTABLISH
 
If you are established in EU/EEA country, you as physical or legal person, have freedom to provide services on a permanent basis in Croatia, if you register an establishment in Croatia and submit the following documentation i.e. fulfil  the following conditions:
  • request for obtaining a decision on meeting the requirements for the  type and category of nautical tourism port or a decision on meeting the requirements for the type of other facility for the provision of vessel berthing and accommodation services
  • OIB or an excerpt from the court register (for a legal entity) or trade register (for a natural person) with a registered activity for the provision of services in nautical tourism
  • proof of the right to use business premises (purchase agreement, excerpt from the land register as proof of ownership, lease agreement, etc.)
  • concession, if necessary (in accordance with special regulations governing concessions on maritime domain)
  • proof of “usability” of the building (according to the Construction Act)
  • general and special conditions for the type and category of nautical tourism port or the type of other facility for the provision of vessel berthing and accommodation services.
 
Fees
 
EUR 27.87 for decision for anchorage, dry storage, nautical mooring
EUR 92.91 for dry marina decision
EUR 139.36 for marina decision
 
Payment via internet banking
 
Payments are made according to the state budget but depend on the county.
 
Information on payment for marinas is provided by the Ministry.

For anchorage, dry storage, nautical mooring - competent administrative bodies according to the place where the anchorage, dry storage, nautical mooring is located:
 
Administration office for the county, i.e. the administrative body of the City of Zagreb competent for tourism

Authorization
 
Decision on meeting the minimum requirements for the type and category of the marina
Decision on meeting the minimum requirements for other facilities for the provision of berth services and accommodation for nautical tourism vessels
 
Deadline: 60 days
 
Legal remedies
 
Possibility to appeal to the Ministry of Tourism and Sport, Prisavlje 14, 10 000 Zagreb or to pisarnica@mints.hr, within 15 days of delivery of the decision, without paying the administrative fee.
 
No appeal is allowed against the decision of the Ministry of Tourism and Sports, but an administrative dispute may be initiated by filing a lawsuit with the Administrative Court in Zagreb within 30 days from the delivery of the decision. The lawsuit is submitted to the Administrative Court in Zagreb directly in writing, verbally on the record at the Court or sent by mail or electronically.
